  1. Neal should have requested the returns immediately. If the state released them right away, there would have been nothing to enjoin. I think Neal didn’t want to request the state returns because it might make the arguments supporting his request for federal returns less compelling. And the state returns will not provide a complete picture.
    Even so, filing a suit doesn’t stop anything. Trump needs to get an injunction to stop the state. While he might get a TRO to allow for argument, preliminary and permanent injections will be an uphill battle.
