The Supreme Court has dropped Trump’s travel ban case from its schedule.
- SUPREME COURT DROPS TRAVEL BAN CASE FROM ARGUMENT SCHEDULE
- SUPREME COURT ASKS PARTIES TO SAY WHETHER TRAVEL CASE IS MOOT
So basically, by issuing a revised version (“3.0”) of the order, Trump has obviated the need to consider the original case.
“In general, when one policy expires and a new policy is developed, the court may consider any challenge to the expired policy to be moot,” Irv Gornstein, the executive director of the Supreme Court Institute at Georgetown Law said over the weekend.
You’ll recall that more than a few commentators said this was the SCOTUS plan all along. That is, they intended to kick the can until the government produced something different.
Now, apparently, both the administration and folks challenging the ban will need to file new file briefs centered on the effect of the revised policy.
This will of course do absolutely nothing to settle this argument as is pretty clear from the following statement released by Nancy Pelosi this afternoon…
